However, he has since appeared to walk back those threats after he said Tehran suspended planned executions. The National Iranian American Council (NIAC) said on Thursday it had learned that Trump&#39;s administration was planning to restart deportation flights to Iran, after prior removals in September and December. Abolfazl Mehrabadi, a diplomat representing Tehran&#39;s interests in the United States, told Iran&#39;s official IRNA news agency on Saturday that about 40 Iranians were to be&nbsp;<a href="https://www.pakistantv.com/article/record-3258-indians-deported-from-us-this-year-jaishankar-tells-parliament" target="_blank" style="color: rgb(0, 0, 0);" rel="noopener noreferrer">deported</a>. They will depart on Sunday from an airport in Phoenix, Arizona, he said. Among them are two gay men currently being held in an immigration detention center in Arizona. Legal proceedings to prevent their deportation are still ongoing, according to the organization. The US Department of Homeland Security did not immediately respond to AFP queries about the planned deportations.

Data from the immigration department shows that 74% of Indian student visa applications were rejected in August 2025, compared to 32% a year earlier. ISLAMABAD: The US federal government shutdown has become the second-longest in its history, entering its 23rd day, with no immediate end in sight. This is jeopardizing the legal status of many individuals, including Pakistanis, in the US workforce who are employed on H-1B, EB-2, or EB-3 visa programs.&nbsp; One of the hardest-hit areas is immigration services, which have been scaled back due to funding constraints. These services collectively manage visa applications of individuals employed under various employment visa programs in the US and include the Department of Labor,&nbsp;US Citizenship and Immigration Services,&nbsp;and the Department of State.&nbsp; Mujeeb Ullah Kakar, a&nbsp;43-year-old&nbsp;Pakistani IT professional,&nbsp;is among those dealing with the repercussions of a prolonged federal shutdown.&nbsp; A resident of Maryland, Kakar arrived in the US in 2022 from Karachi on an H-1B visa sponsored by a multinational company.&nbsp; Speaking to Pakistan TV Digital, he said, &ldquo;I was supposed to apply for a three-year visa extension. My company was ready to submit papers, but [they are] not anymore.&rdquo; To continue with his employment, Kakar must obtain a legal document issued by the Department of Labor (DOL), which is currently not operational.&nbsp; Kakar says he is anxious about the uncertainty of the situation, which was troubling him and his family of five.&nbsp; &ldquo;The first thing I do when I wake up is to check the news. [Check] if the shutdown has ended,&rdquo; he said.&nbsp; Which immigration services are still working&nbsp;Certain immigration-related agencies that are still operating include United States Citizenship and Immigration Services (USCIS), which handles adjustment of status cases and other visa services paid by the client, said US-based immigration attorney Waseem Chachar.&nbsp; He said that the Department of State was also operational.&nbsp; According to Chachar, Customs and Border Protection (CBP) was indispensable, but the visa sections overseas might be understaffed, leading to longer wait times and delayed interview appointments for new visa issuance.&nbsp; On the other hand, the Immigration and Customs Enforcement (ICE) department, allegedly carrying out controversial raids against &quot;illegal immigrants,&quot; will continue working as before. Services that are completely shut down&nbsp;While DOL has suspended all its functions, certain visa categories require approval of a Labor Condition Application before an H-1B visa application is submitted. Kakar is waiting to apply for one.&nbsp; But the H-1B visa is not the only employment-based visa category that requires a letter from DOL; the EB-2 and EB-3 categories also require a Permanent Labor Certification (PERM) from DOL to proceed. DOL is also responsible for providing certain documents for H2-A, H2-B visa categories, issued for agriculture workers; CW visas for crewmembers working in longshore positions; U visas, issued to protect victims of crime who have suffered mental and physical abuse, and T visas, reserved for victims of human trafficking who agree to assist law enforcement agencies. How many Pakistanis are on H1B, EB-2, and EB-3 visas?According to US government statistics, more than 3,000 Pakistanis hold H-1B visas, issued in 2024.&nbsp; Pakistan ranks 8th among the countries eligible to avail of this visa.&nbsp; Most of these professionals are either associated with software development or with project management and networking.&nbsp; There is little data available on Pakistanis who have been approved for EB-2 and EB-3 visas, which are offered to competent professionals.&nbsp; How worrisome is the situation for these visa holders?Kakar is troubled by missing his official deadline to submit extension papers, which can complicate his legal status in the US.&nbsp; &ldquo;I mean, these are strange times. So many people are detained. Sometimes for no reason these days. You cannot be sure of your future,&rdquo; Kakar said while referring to the ICE mass deportation raids.&nbsp; Attorney Chachar sees a fully functional USCIS as a silver lining.&nbsp; He admitted that the fear of deportation or failing to meet legal requirements while on US soil was not entirely unfounded, but these are considered &quot;extraordinary circumstances.&quot;&nbsp; He said that people who miss their legal deadlines might have their immigration cases and visa statuses addressed by USCIS later under that clause.&nbsp; They will have to &ldquo;explain and convince the department that things were beyond their control&rdquo; to avoid all legal issues.&nbsp;Although no one can be sure of the outcome due to ongoing federal policy changes, he added. For individuals like Kakar, appealing to USCIS could be a legitimate option to pursue his visa case further once the shutdown ends. &nbsp; Kakar said his lawyer told him that, once the shutdown ends, he will receive the required letter from DOL to apply for an extension of his H-1B visa. But to him, &ldquo;this is the worst time to do this, as immigration laws are stricter than they have ever been.&rdquo;&nbsp; Kakar said he was more concerned about his children, all school-age, who he feared were also struggling with the unpredictability surrounding the future of their education.&nbsp; &ldquo;I had to find a new school for my eldest daughter; she is completing her middle school. But I am just waiting and thinking that we might have to head back,&rdquo; he lamented.

US govt shutdown threatens legal status of employment visa holders

SAN DIEGO: The Trump administration is tapping National Guard and Army Reserve lawyers to be temporary immigration judges after firing dozens of existing judges, the latest step in a broader plan that experts warn could harm immigration courts and the military justice system. Training for the first group of Army lawyers begins Monday, and training for the second group is expected to start in the spring, several former and current military reserve lawyers said they were told. Roughly 100 Army Reserve lawyers are expected to participate, with 50 beginning a nearly six-month assignment immediately after their training, according to a Sept. 3 email sent to an Army Reserve attorney and reviewed by The Associated Press. The administration wants to bring in as many as 600 military-trained attorneys to help make decisions about which immigrants can stay in the country. Advocates are alarmed by the move to use military lawyers to bolster staffing in the backlogged immigration courts as President Donald Trump&rsquo;s administration ramps up immigration arrests. Those courts have yearslong waits for hearings, and the number of pending cases has more than doubled in the past four years to 3.4 million. Both the Army and National Guard said they hope to fill the assignments with volunteers. &ldquo;This assignment provides the opportunity to gain judicial experience in a high-tempo, nationally significant setting,&rdquo; an email sent to members of the Army&rsquo;s Reserve Legal Command stated, adding that locations and other details will be released later. A notification seeking volunteers sent Sept. 6 to active-duty and reserve National Guard members said &ldquo;ideal candidates will possess experience in administrative law, immigration law, service as a military judge&rdquo; or a related field. Applicants should have sound judgment, impartiality, and a &ldquo;suitable temperament for the role,&rdquo; it said. The Trump administration increasingly has turned to the military to support its crackdown on illegal immigration. That has included troops patrolling the US-Mexico border, National Guard members being sent into US cities to support immigration enforcement efforts, housing people awaiting deportation on military bases, and using military aircraft to carry out deportations. Concerns over lack of trainingImmigration judges each manage hundreds or thousands of cases, deciding who gets asylum and green cards to stay in the US. Their rulings shape both the lives of immigrant families and the success of Trump&rsquo;s crackdown. Some immigration and military law experts are concerned the reservists will be put in the job without enough training or experience after more than 100 immigration judges were fired or left. With only about 600 immigration judges remaining, the Pentagon move would double their ranks. Trump&rsquo;s sweeping new tax and spending law provided $170 billion for immigration enforcement, including the hiring of 10,000 Immigration and Customs Enforcement employees, but it caps the number of permanent immigration judges at 800. &ldquo;They&rsquo;re letting a lot of experienced judges go, terminating them with no notice, and yet they claim that there&rsquo;s a shortage so they need to have these military JAG officers step in and take over,&rdquo; said Margaret Stock, a retired Army lieutenant colonel and immigration lawyer. Of particular concern, the administration is not requiring experience as an administrative law judge or in immigration law as in the past, she said. Stock has taught seminars on immigration law at West Point but said military lawyers learn only a minimal amount to be able to help fellow service members with things like visas for spouses or children.&ldquo;Immigration law is super technical and complicated,&rdquo; she said. &ldquo;It&rsquo;s worse than tax law, and it&rsquo;s constantly changing. And it has its own terminology, its own rules that don&rsquo;t make any sense.&rdquo; Immigration judges come from a range of legal backgrounds, including the military, the Justice Department, immigration enforcement agencies, and private practice. The government previously required applicants to have seven years&rsquo; experience before undergoing a lengthy hiring process, then six weeks of training followed by a two-year probation period.Until now, temporary judges needed 10 years of legal experience in immigration and were often retired immigration judges, according to the government&rsquo;s rule laying out the new plan. The Defense Department did not return an email seeking comment. The Executive Office for Immigration Review, which runs the immigration courts, declined to comment. In the rule, the agency wrote that many successful immigration judges had little experience in immigration law before taking the job. &ldquo;Immigration law experience is not always a strong predictor of success,&rdquo; the rule said. In the military, an attorney is known as a judge advocate general, or JAG. They study at accredited law schools and pass the bar exam before going into a military law program for just over two months. They sometimes work as special assistants to US attorneys and gather evidence to prosecute criminal cases, much like civilian prosecutors do, said Mark Nevitt, a former Navy JAG and associate professor at Emory University School of Law. &ldquo;They are some of the greatest lawyers you&rsquo;ll meet in the national security world,&rdquo; but this will require they &ldquo;get up to speed pretty quickly on a complex body of law and then adjudicate matters and claims as a judge,&rdquo; Nevitt said. Matt Biggs, president of a federal employee union that represents immigration judges, said tapping lawyers with little or no immigration experience to hear these complex, high-stakes cases will likely do more harm than good. &ldquo;It will lead to more appeals of decisions. It will further increase the backlog. It&rsquo;s going to be an inefficient and costly endeavor,&rdquo; Biggs said. &ldquo;It sets a dangerous precedent in this country when it comes to due process protections.&rdquo; Gregory Chen of the American Immigration Lawyers Association said the Justice Department is &ldquo;watering down the qualifications of those it will empower to make life-or-death decisions.&rdquo; He also worries the administration will hold too much sway over the temporary hires. The permanent judges are government employees with civil service protections. Democrats have questioned the plan&rsquo;s legalitySome Democratic senators have warned the Pentagon plan may violate the Posse Comitatus Act, which bans service members from carrying out law enforcement duties, and fear taking away the JAGs could harm the military justice system.&nbsp; They sent a letter to the offices of the top military lawyers for the four services, asking where the roughly 600 lawyers will be coming from and what legal analysis the military has conducted. A Pentagon memo describing the plan said the appointments should be for no longer than six months. The memo also said the Justice Department would be responsible for ensuring the military lawyers don&rsquo;t violate the Posse Comitatus Act. If the military lawyers serve entirely under civilian personnel, then it could be legal, Nevitt said, but it&rsquo;s unclear. Some immigrant advocates believe the administration is presuming military lawyers are more likely to deny cases to meet Trump&rsquo;s deportation goals. But Greg Rinckey, a former Army lawyer who is now in private practice, said that assumption is wrong. &ldquo;They will not rubber stamp because most of us have served as defense counsel,&rdquo; he said. &ldquo;We&rsquo;re not all government hacks.&rdquo; A number of his friends who are Army Reserve JAGs have signed up because they are interested in immigration law and want to serve a national need, he said. &ldquo;And also it&rsquo;s a way to put something else on your resume &mdash; that you served as a judge.&rdquo;

LOS ANGELES: An elderly US man who was body slammed to the ground as immigration agents raided his Los Angeles car wash said Thursday he is lodging a $50 million damages claim against the government. Surveillance video shows Rafie Shouhed being violently manhandled by several masked and heavily armed agents, who then took him into custody where he says he was held for nearly 12 hours without medical attention. &lsquo;I was begging (them)&rsquo;&quot;The way they treated me, the way they attacked me. I was begging (them), &#39;I have a heart condition.&#39;&quot; Shouhed told reporters. Shouhed said he had gone out to speak to the men to find out what was happening. &quot;They told me nothing. The only word they say: &#39;You do not f... with ICE,&#39;&quot; said Shouhed, who moved to the United States from Iran in the 1980s. ICE refers to the Immigration and Customs Enforcement agency. The raid on Shouhed&#39;s car wash this month was part of President Donald Trump&#39;s ramped-up program against undocumented migrants as he looks to fulfill an election pledge to deport millions of people. The raids have been controversial, particularly in multiethnic Los Angeles, in part because they appear to target people simply because they speak Spanish or are working at locations like car washes. &lsquo;I cannot breathe&rsquo;Video shows three masked men pinning Shouhed to the ground, with one of them appearing to put a knee on his neck. The 79-year-old said he told agents &quot;I cannot breathe, I cannot breathe.&quot; Attorneys acting for Shouhed said their client&#39;s pleas, including his explanation that he had recently undergone heart surgery, were ignored. &quot;He was held nearly 12 hours without medical attention. Even after agents admitted they knew he was a US citizen, he was kept in custody,&quot; the claim says. Shouhed, a Trump voter, was released without charge. He was later treated in hospital for broken ribs, serious elbow injuries and traumatic brain injury, lawyers said.
